House Bill Would Exclude Noncitizens From Congressional Apportionment and Add Census Citizenship Question

Scope: Federal

Branch: Legislative

Severity: Amber

Date occurred: September 15, 2026

H.R. 10377 was introduced in the 119th Congress to exclude noncitizens from the population base used for apportioning seats in the House of Representatives, to require a revised apportionment before certain elections, and to require a citizenship question on all future decennial censuses. The bill was referred to the Committee on the Judiciary and additionally to the Committee on Oversight and Government Reform.

Constitutional basis: Would redefine the apportionment base against the Fourteenth Amendment's 'whole number of persons' language; novel assertion, still only referred to committee.
