Michigan Senate Bill Would Revoke Nonprofit Corporations’ Power to Spend in Elections and on Ballot Questions

Scope: State (Michigan)

Branch: Legislative

Severity: Amber

Date occurred: September 10, 2026

Michigan SB 1086 would amend the Nonprofit Corporation Act (1982 PA 162) to revoke the power of nonprofit corporations to make expenditures in candidate elections or on ballot questions, amending sections 261, 271, 821, 1012 and 1041 and adding section 261a. The bill is tie-barred to SB 1085 and SB 1087 and remains in the Senate, where an additional co-sponsor was named.

Constitutional basis: Introduced bill still in the Senate with no enactment, and a statutory ban on corporate independent election spending tests settled First Amendment expenditure doctrine.
