Ohio Enacts SB 1 Restructuring Public University Governance, Speech Policies, and Faculty Bargaining

Scope: State (Ohio)

Branch: Legislative

Severity: Amber

Date occurred: June 27, 2025

Ohio Senate Bill 1, the Advance Ohio Higher Education Act, took effect June 27, 2025, amending and enacting numerous Revised Code sections governing state institutions of higher education. The act addresses institutional positions on controversial topics, diversity programming, post-tenure review, syllabus disclosure, and amends collective bargaining provisions in Chapter 4117 concerning faculty strikes.

Constitutional basis: Legislature's plenary authority over state-chartered universities extended into regulating institutional and faculty expression and barring strikes, a novel application not yet judicially tested.
